When you read this part of the law, some words have special meanings. A bodily sample is a person's biological fluid, tissue, or breath. The Director testing means the Director carries out drug or alcohol tests under section 40Z. You need to know what a drug or alcohol test is. It is a test to see if a person has alcohol or a testable drug in their bodily sample. The test can show if the substance is present or not, and sometimes it can show the level of the substance. A negative result means the test shows no alcohol or testable drug is present. It can also mean the substance is below a certain level set by the maritime rules or the operator's safety system. An operator is a person who runs a ship and has a maritime document to do so. They must follow a management system to keep people safe, as required by section 17(4)‎(a). A safety-sensitive activity is a task that could affect people's health or safety on a ship. A safety-sensitive worker is someone who does these tasks for an operator. A safety system is the management system that operators must follow. A testable drug is a drug that could impair a worker's ability to do their job safely. It includes drugs listed in the maritime rules or in the operator's safety system, as mentioned in section 40Z(4)‎(a).
