54A: Power of Director to investigate holder of maritime document

54APower of Director to investigate holder of maritime document

  1. The Director may, in writing, require any holder of a maritime document to undergo an investigation if the Director—

  2. has reasonable grounds to believe that an investigation is necessary in the interests of maritime safety; and
    1. either—
      1. believes that the maritime document holder has failed to comply with any conditions of a maritime document; or
        1. considers that the privileges or duties for which the maritime document has been granted are being carried out by the maritime document holder in a careless or incompetent manner.
        2. If the Director requires a maritime document holder to undergo an investigation under subsection (1), the Director must—

        3. conclude the investigation as soon as practicable; and
          1. inform the maritime document holder, in writing, of—
            1. the date on which the investigation will begin; and
              1. the results of the investigation, including—
                1. any recommendations arising out of the investigation; and
                  1. the grounds for those recommendations.
