406: Communicating fraudulent, misleading, or false information

If you give false information to the Authority or the Director, you commit an offence. This happens when you know the information is fraudulent, misleading, or false, and you provide it to them anyway. You do this by any means, and the information is relevant to the Authority's or the Director's powers under the Maritime Transport Act.

You also commit an offence if you are applying for a maritime document and you do not provide information that you know is relevant to the Authority's or the Director's powers. This is the case if you do not have a reasonable excuse for not providing the information.

If you already have a maritime document, you commit an offence if you do not provide information that you know is relevant to a condition specified in section 41(5), and you do not have a reasonable excuse for not providing the information.

General offences

406Communicating fraudulent, misleading, or false information

  1. Every person commits an offence who,—

  2. by any means, provides to the Authority or to the Director information relevant to the Authority’s or the Director’s exercise of powers under this Act, or under regulations or rules made under this Act, knowing the information to be fraudulent, misleading, or false; or
    1. being an applicant for a maritime document, or a marine protection document, or an applicant for recognition of a document as a maritime document or a marine protection document, fails, without reasonable excuse, to provide to the Authority or the Director information known to that person which is relevant to the Authority’s or the Director’s exercise of powers under this Act, or under regulations or rules made under this Act; or
      1. being the holder of a maritime document, or the holder of a document recognised as a maritime document, fails, without reasonable excuse, to provide to the Authority or the Director information known to that person which is relevant to the condition specified in section 41(5).
