263: Offences in respect of radioactive waste and other radioactive matter

"Breaking the rules about radioactive waste on ships and aircraft is against the law"

If you are the master or owner of a ship, you commit an offence if radioactive waste or other radioactive matter is taken on board or dumped from the ship in breach of certain rules, such as those outlined in section 258(1). You can find these rules in section 258(1) which talks about what you can and cannot do with radioactive waste or other radioactive matter on a ship. This also applies to aircraft, where the person in possession and the owner can commit an offence if radioactive waste or other radioactive matter is taken on board or dumped in breach of the rules.

If you own a controlled offshore installation, you commit an offence if radioactive waste or other radioactive matter is taken on board any ship or aircraft at the installation in breach of section 258(1)(b). The rules are in place to prevent harm to people and the environment. You should be aware of these rules to avoid committing an offence.

The master and owner of a New Zealand ship, and the person in possession and owner of a New Zealand aircraft, also commit an offence if radioactive waste or other radioactive matter is dumped in breach of section 258(1)(e). These rules are part of the Maritime Transport Act 1994. You can read more about the rules in section 258(1) to understand what is allowed and what is not.
