461: Consular officer to be notified of detention of foreign ship

If a foreign ship is stopped at a port in New Zealand, you need to tell some people about it. The person who stopped the ship or started the court case must tell the Director about it and why they did it. The Director must then tell a consular officer from the country where the ship is registered.

The Director must give the consular officer the reasons why the ship was stopped or why the court case was started. This rule does not change what is said in section 55 or section 397. These are other parts of the law that still apply.

461Consular officer to be notified of detention of foreign ship

  1. Where pursuant to any provision of this Act any foreign ship is detained at a port in New Zealand, or any proceeding is taken against the owner of a foreign ship or any other person for the time being responsible for the navigation and management of the ship or against the master of the ship, the following provisions shall apply:

  2. in any case where the person ordering or giving notice of that detention, or, as the case may be, instituting that proceeding, is not the Director, that person shall forthwith inform the Director thereof and of the reason therefor:
    1. in every case the Director shall forthwith cause notice thereof to be served on a consular officer of the country in which the ship is registered or to which the ship belongs; and the notice shall specify the grounds on which the ship has been detained or, as the case may be, the grounds on which the proceeding has been taken.
      1. Nothing in this section shall affect the provisions of section 55 or section 397.
