If you operate, maintain, or service a ship or marine protection product without the right document, you commit an offence. You also commit an offence if you do any other act in respect of a ship or marine protection product without the right document. The right document is called a marine protection document and it must be current.

If you know a ship or marine protection product needs a current marine protection document before you can do something with it, and you know you do not have the right document, you commit an offence if you do that thing anyway. This includes operating, maintaining, or servicing the ship or product.

A marine protection document is not considered current if it is suspended under the Maritime Transport Act, or if the part of the document that allows you to do a certain act is suspended. 277Acting without necessary marine protection document

  1. Every person commits an offence who—

  2. operates, maintains, or services; or
    1. does any other act in respect of—
      1. any ship or marine protection product, without holding the appropriate current marine protection document.

      2. Every person commits an offence who—

      3. operates, maintains, or services; or
        1. does any other act in respect of—
          1. any ship or marine protection product knowing that a current marine protection document is required to be held in respect of that ship or product before that act may lawfully be done and knowing that the appropriate document is not held.

          2. For the purposes of this section,—

          3. a marine protection document is not a current marine protection document if it is for the time being suspended under this Act:
            1. a marine protection document is not a current marine protection document in relation to an act if the endorsement that is required to authorise that act is for the time being suspended under this Act.
