53: Suspended persons not to work or be employed

If you have been suspended under section 52, you cannot work on a New Zealand ship or any ship involved in coastal shipping under section 198. You also cannot offer to work on these ships. If you do, you will commit an offence.

If you commit this offence without a good reason, you can be fined. As an individual, your fine can be up to $5,000. As a company, your fine can be up to $50,000.

You must not employ someone who has been suspended under section 52 to work on a New Zealand ship or any ship involved in coastal shipping under section 198. This rule applies to you if you are going to work on these ships or if you are employing someone to work on them.

53Suspended persons not to work or be employed

  1. No person shall employ or engage on board a New Zealand ship, or any ship involved in coastal shipping under section 198, a person who has been suspended under section 52.

  2. No person who has been suspended under section 52 shall offer himself or herself for work or employment on board a New Zealand ship, or any ship involved in coastal shipping under section 198.

  3. Every person commits an offence who, without reasonable excuse, contravenes this section.

  4. Every person who commits an offence against subsection (3) is liable on conviction,—

  5. in the case of an individual, to a fine not exceeding $5,000:
    1. in the case of a body corporate, to a fine not exceeding $50,000.
