17: Role of Minister

17Role of Minister

  1. The Minister has the functions, duties, and powers given to him or her under this Act.

  2. The Minister has a role in the food safety regime that includes, without limitation,—

  3. for the purposes of this Act, issuing national outcomes in relation to the performance by territorial authorities of their functions and duties, or the exercise of their powers, under this Act; and
    1. recommending the making of regulations, including regulations that—
      1. amend Schedules 1 to 3:
        1. state the scope and purpose of national programmes and prescribe other matters relating to national programmes:
          1. impose national programmes:
            1. prescribe fees and charges for the purposes of the cost recovery provisions in subpart 3 of Part 4:
              1. impose levies for the purposes of those cost recovery provisions:
                1. provide for exemptions, waivers, and refunds in relation to those levies:
                  1. exempt persons from the application of this Act generally:
                    1. exempt food to be exported from certain requirements of this Act:
                      1. declare anything to be or not to be food for the purposes of this Act:
                        1. declare anything to be or not to be a food business for the purposes of this Act:
                          1. declare any Act to be an Act for the purposes of section 368(3):
                            1. declare any person to be a person for the purposes of section 368(4); and
                            2. adopting joint food standards; and
                              1. issuing domestic food standards; and
                                1. appointing persons to conduct reviews of certain decisions made by the chief executive.
