When the Food Act 2014 becomes law, some parts of the old Food Act 1981 will stop being law. The Food Act 1981 has sections that will stop being law on a specific date. You can find out when this happens by looking at section 2(3)(b) and section 2(1).

The Dietary Supplements Regulations 1985 will still be in force, as if they were made under the new Food Act 2014. These regulations can be treated as if they were made under sections 343 and 383 of the new Act. They can also be changed or stopped as if they were made under the new Act.

420Pre-commencement legislative requirements: Food Act 1981 and regulations

  1. Sections 37 and 40 of the Food Act 1981 are repealed on the day after the date on which this Act receives the Royal assent (see section 2(3)(b)).

  2. The other provisions of the Food Act 1981 are repealed on the date or dates appointed by Order in Council for the purpose of their repeal (see section 2(1)).

  3. The Dietary Supplements Regulations 1985

  4. continue in force as if made under this Act; and
    1. are to be treated as if made under sections 343 and 383 of this Act; and
      1. may be amended or revoked as if made under this Act.

          1. an amendment to those regulations under subsection (3)(c).
