51: Operator of registered food control plan must notify registration authority of significant change in circumstances

51Operator of registered food control plan must notify registration authority of significant change in circumstances

  1. The operator of a registered food control plan must give written notice to the registration authority of any significant change in circumstances.

  2. The notice under subsection (1) must be given—

  3. before the significant change in circumstances occurs; or
    1. if compliance with paragraph (a) is not practicable, as soon as practicable after the significant change in circumstances occurs but, in any event, not later than 10 working days after the change occurs.
      1. In this section, significant change in circumstances

      2. means—
        1. any change in any of the following information that the operator has provided under section 53 in respect of an application for registration of the food control plan:
          1. the information required under section 42(a) to (e) and (h)(ii):
            1. the verifier or verification agency that will carry out verification functions in respect of the plan:
            2. any change in the information that the operator has provided under section 55 in respect of an application for registration of the food control plan:
              1. any matter that results in the food control plan not meeting the criteria under section 56; and
              2. includes the death, bankruptcy, receivership, voluntary administration, or liquidation of the operator of the plan or the operator of a food business to which the plan applies.
                1. If subsection (3)(b) applies to the operator of the plan, the person who assumes control of the operator's business must give the written notice required by subsection (1).
