If you have a registered risk management programme under the Animal Products Act 1999, you are exempt from some rules. You are also exempt if you are covered by a regulated control scheme for producing or processing animal materials or products under that Act.

You might be exempt if you do not need a risk management programme for certain animal materials or products under section 9 or section 14 of the Animal Products Act 1999. You are also exempt if you are exempt under section 13(3) of that Act from operating under a risk management programme.

349Exemption for certain persons covered by Animal Products Act 1999

  1. This section applies to a person who—

  2. is required to have, or has, a registered risk management programme under the Animal Products Act 1999; or
    1. is covered by a regulated control scheme under that Act for the production and processing of an animal material or animal product; or
      1. is exempt under section 9 or 14 of that Act from the requirement to have a risk management programme for an animal material or animal product unless the exemption is provided on the ground that the person is operating, or is required to operate, under a risk-based measure; or
        1. is exempt under section 13(3) of that Act from the requirement to operate under a risk management programme.
          1. A person to whom this section applies is exempt from the requirement to operate under an applicable risk-based measure for the activities to which the risk management programme, regulated control scheme, or exemption relates.
