316: Releasing food or food-related accessory that has been detained

If you are a food safety officer, you must release food or a food-related accessory that you seized and detained under section 306 when you are satisfied that the costs of removal and detention under section 314 have been paid. You also need to be satisfied that the food or food-related accessory is safe and suitable, and that it is not needed as evidence in a court case.

You have to make sure all the rules in the Act have been followed before you release the food or food-related accessory.

When you release the food or food-related accessory, you must give it back to the person who had it when you seized it.

316Releasing food or food-related accessory that has been detained

  1. A food safety officer must release food or a food-related accessory that the officer seized and detained under section 306 when satisfied that—

  2. the costs of removal and detention under section 314 have been paid and the other applicable requirements of this Act have been complied with; and
    1. the food or food-related accessory is safe and suitable; and
      1. the food or food-related accessory is not required as evidence in proceedings for an offence against this Act.
        1. The officer must release the food or food-related accessory to the person who possessed it at the time it was seized.
