If you have a food business that is part of a national programme, the registration authority can stop some or all of your operations at any time. This can happen if they think your food does not meet the rules of the Food Act 2014, or if it might harm people's health. They can also stop your operations if they think you have failed to follow the rules of the national programme in a serious way, which could make your food unsafe.

The registration authority follows rules set out in clause 4 of Schedule 4 when deciding whether to stop your operations. They need to have good reasons to believe there is a problem with your food business.

If the registration authority stops your operations, it can be for up to 3 months.

90Mandatory suspension

  1. The registration authority may, at any time, suspend all or any operations of a registered food business that is subject to a national programme in accordance with clause 4 of Schedule 4 if it has reasonable grounds to believe that—

  2. the food traded by the food business does not meet, or no longer meets, the applicable requirements of this Act; or
    1. the food traded by the food business may pose a risk to human life or public health; or
      1. there is or has been a serious failure of operations or there are or have been other matters (including non-compliance with the conditions of registration) under the national programme that cast doubt on the safety and suitability of food traded by the food business.
        1. The maximum period of suspension under this section is 3 months.
