52: Application for registration: who is appropriate registration authority

When you apply to register a food control plan, you need to know who to apply to. If your plan is based on a template from the chief executive under section 39, you apply to your local council, unless you have businesses in more than one area. In that case, it might be tricky to figure out which council to apply to.

If your plan is not based on a template, you apply to your local council if the rules say they can handle this type of application. If the rules do not say this, you apply to the chief executive. The chief executive is a person in charge of making sure the food rules are followed.

When we talk about your local council, we mean the council that is in charge of the area where your business is located. If you have a food truck or a mobile business, your local council is the one where your business address is.

52Application for registration: who is appropriate registration authority

  1. The appropriate registration authority for a food control plan that is based on a template or model issued by the chief executive under section 39 is the relevant territorial authority, unless the plan applies to more than 1 place of business and the definition in subsection (3) would result in more than 1 relevant territorial authority.

  2. The appropriate registration authority for all other food control plans is—

  3. the relevant territorial authority, if regulations made under this Act authorise the territorial authority (either generally or specifically) to perform this function; or
    1. the chief executive, in any other case.
      1. In this Act, relevant territorial authority means,—

      2. if the application for registration relates to 1 or more fixed places of business, the territorial authority that, under this Act, is responsible for performing the function of a registration authority for the district or combined district where the 1 or more places are situated; or
        1. if the application for registration relates to a mobile food business, the territorial authority that, under this Act, is responsible for performing the function of a registration authority for the district or combined district where the business address of the mobile food business is situated.
