You commit an offence if you sell food that is not safe or suitable for eating. This food must also not meet the requirements of the Food Act 2014, and you must know this or not care about it. You can be in trouble if you sell food that does not comply with the Food Act 2014.

If you break this law, you can get in trouble. A company can be fined up to $500,000 if they break this law.

If you are an individual and you break this law, you can go to prison for up to 2 years and be fined up to $100,000.

232Offence involving knowingly or recklessly selling non-complying food

  1. A person commits an offence if—

  2. the person sells food that—
    1. is not safe or suitable for its intended purpose; or
      1. has not been produced or processed and handled as required by an applicable requirement of this Act; or
        1. does not comply with an applicable requirement of this Act; and
        2. the person—
          1. knows that the food is as described in paragraph (a); or
            1. is reckless as to whether the food is as described in paragraph (a).
            2. A person who commits an offence against this section is liable on conviction,—

            3. for a body corporate, to a fine not exceeding $500,000:
              1. for an individual, to—
                1. imprisonment for a term not exceeding 2 years; and
                  1. a fine not exceeding $100,000.
