The chief executive can share information with someone outside New Zealand if they have an agreement. You can find out more about this in section 370. Before making an agreement, the chief executive must talk to the Privacy Commissioner and make sure the agreement is necessary to help with something like investigating a problem with the law in New Zealand or another country.

The chief executive must also make sure the agreement is necessary to help with a problem that is affecting trade between New Zealand and another country. The agreement must be written down and say what information can be shared, how it can be used, and if it can be shared with anyone else.

The agreement must also say who can get the information, how much of it they can get, and under what conditions they can get it. It can also say how the information is shared and in what form.

371Disclosing information outside New Zealand: under agreement

  1. The chief executive may disclose information under section 370 under an agreement that is made between the chief executive and the overseas person.

  2. Before making an agreement, the chief executive—

  3. must consult the Privacy Commissioner; and
    1. must be satisfied that the agreement is necessary—
      1. to help investigate, prevent, identify, or respond to non-compliance with the law in New Zealand or in the overseas country; or
        1. to respond to a difficulty arising in the course of trade between New Zealand and the overseas country.
        2. The agreement—

        3. must be in writing; and
          1. must state the criteria for the disclosure of information under it to the overseas person; and
            1. must state the use that the overseas person may make of the information disclosed; and
              1. must state whether or not the overseas person may disclose the information disclosed to any other person; and
                1. if the overseas person may disclose any of the information disclosed to any other person, must state—
                  1. the persons to whom the overseas person may disclose it; and
                    1. the extent to which the overseas person may disclose it; and
                      1. the conditions subject to which the overseas person may disclose it; and
                      2. may state—
                        1. the form in which the information may be disclosed; and
                          1. the method by which the information may be disclosed.
