69: Effect of cancellation of registration

If the registration of a food control plan is cancelled, the registration authority may direct you to not sell any food that was imported, produced, or processed under the affected operations. The authority may also tell you to take action to deal with the affected food or operations. You may be required to follow the rules outlined in section 285 as well.

When the registration authority is the relevant territorial authority, they have the same powers as the chief executive under section 285. This means they can make decisions about your food business.

If your registration is cancelled, it does not stop the registration authority from taking other actions against you under the Food Act 2014.

69Effect of cancellation of registration

  1. If the registration of a food control plan is cancelled, the registration authority may—

  2. direct that any food imported, produced, or processed and handled under any affected operations must not be sold; and
    1. direct the operator of the food business or person in control of any affected food, food-related accessories, or operations of the food business to take appropriate action to deal with the affected food, food-related accessories, or operations; and
      1. exercise any of the other powers under section 285.
        1. Section 285 applies to a registration authority that is the relevant territorial authority as if references to the chief executive in that section were references to the relevant territorial authority.

        2. A cancellation of registration does not affect any other actions that the registration authority may take under this Act.
