If a registered importer's operations are suspended under section 122 or 124, or the suspension period is extended under section 123, the chief executive can tell you what to do with the food. The chief executive can direct you not to sell any food imported, produced, or processed under the suspended operations. They can also tell you to take action to deal with the affected food and use powers under section 285.

When the chief executive suspends a registered importer's operations, they must make sure the suspension is recorded on the public register during that time. You can think of the public register like a list that shows which importers are allowed to operate and which are not.

If the chief executive suspends a registered importer's operations under section 122 or 124, or extends the suspension period under section 123, it does not stop them from taking other actions under the Food Act 2014.

125Effect of suspension

  1. If all or any of a registered importer’s operations are suspended under section 122 or 124 or the period of a suspension of any operations is extended under section 123, the chief executive may—

  2. direct that any food imported, produced, or processed and handled under any affected operations must not be sold; and
    1. direct the registered importer to take appropriate action to deal with the affected food; and
      1. exercise any of the relevant powers under section 285.
        1. The chief executive must ensure that, during the period of suspension, the suspension is recorded on the relevant public register.

        2. A suspension under section 122 or 124 or an extension of a period of a suspension of any operations under section 123 does not affect any other actions that the chief executive may take under this Act.
