The Governor-General can make rules about how the District Court works when it is dealing with certain orders under the Food Act 2014. You can find these orders in sections 334 to 337. The Governor-General can make rules to help the court follow these orders.

The Governor-General already has some powers to make rules, and this is an extra power. The District Court Act 2016 gives the Governor-General some of these powers.

Some of these rules are called secondary legislation, which means they have to be published in a certain way. You can learn more about this in Part 3 of the Legislation Act 2019. There are also rules about how the court works, which you can find in section 228 of the District Court Act 2016.

342Rules of court

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make rules—

  2. regulating the practice and procedure of the District Court in proceedings under this Act that relate to orders under sections 334 to 337:
    1. providing for matters contemplated by, or necessary for giving full effect to, the provisions of this Act that relate to orders under sections 334 to 337.
      1. The power in subsection (1) is additional to all other powers conferred on the Governor-General by the District Court Act 2016.

      2. Rules under subsection (1)(b) are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

      3. As to rules referred to in subsection (1)(a), see section 228 of the District Court Act 2016, which provides that court rules are secondary legislation.
