71: Surrender of registration

If you are in charge of a food control plan, you can give up its registration at any time by sending a written notice to the people who registered it. You need to tell them in writing that you want to surrender the registration. The people who registered your plan might not be the main person in charge, so they may need to tell the main person about your decision.

If someone else registered your plan, they must tell the main person as soon as possible that you have surrendered your registration. This means they have to notify the chief executive about your decision. The chief executive is the main person in charge of registrations.

Giving up your registration does not stop the registration authority from taking other actions against you under the Food Act 2014. This means they can still do other things even if you surrender your registration. 71Surrender of registration

  1. The operator of a registered food control plan may, at any time, surrender the plan’s registration by written notice to the registration authority.

  2. If the registration authority is not the chief executive and is notified of a surrender under subsection (1), the registration authority must, as soon as practicable after being notified, notify the chief executive of the surrender.

  3. A surrender does not affect any other actions that the registration authority may take under this Act.
