If you have a deemed food control plan, you need to know who is in charge of it. The person in charge is called the appropriate registration authority. This authority is either the chief executive or your local council, depending on your situation.

If your business was exempt from some food rules under the Food Act 1981, the chief executive is in charge of your deemed food control plan. You can read about these exemptions in section 8F of the Food Act 1981. This exemption was related to the Food Hygiene Regulations 1974, which you can find here.

The chief executive can add conditions to your deemed food control plan if they want to. If they do this, section 60 will apply to these conditions. Some other sections of the law, like sections 44 to 47 and 62 to 72, also apply to your deemed food control plan.

432Deemed food control plans under sections 430 and 431

  1. The appropriate registration authority for a deemed food control plan is,—

  2. if the business was exempted under section 8F of the Food Act 1981 from the provisions of the Food Hygiene Regulations 1974, the chief executive:
    1. in any other case, the relevant territorial authority.
      1. The chief executive may issue a notice imposing conditions on a deemed food control plan. If the chief executive does so, section 60 applies to the conditions as if they had been imposed under section 60(1).

      2. Sections 44 to 47 and 62 to 72 apply to a deemed food control plan.
