289: Publish privileged statements

The chief executive can publish a statement to protect human life or public health, or to inform the public. You might see statements about the safety of food or things related to food. The chief executive can also talk about things that are said in advertisements about food, and whether people are doing what they are supposed to do under the Food Act 2014.

The statement has something called qualified privilege, which means it is protected in certain ways. This section of the law does not limit what other laws or rules say, or what the chief executive or other people can do.

289Publish privileged statements

  1. The chief executive may publish a statement for the purpose of protecting human life or public health or informing the public.

  2. The statement may be about—

  3. the safety or suitability of food or a food-related accessory:
    1. anything contained or implied in advertisements about food or a food-related accessory—
      1. generally; or
        1. in a particular advertisement; or
          1. in a class of advertisement; or
            1. in classes of advertisements:
            2. the performance or non-performance of any function or duty imposed on any person by this Act or any regulations made under this Act.
              1. The statement is protected by qualified privilege.

              2. Repealed
              3. This section does not limit—

              4. any other enactment or rule of law; or
                1. the functions of the chief executive or of any other person or body.
