Food Act 2014

Risk-based measures - General - Application of risk-based measures

26: Operator of food business may choose to operate under food control plan even if food business is in food sector classified under lower level of risk

You could also call this:

"You can choose a food control plan for your food business, even if it's low risk."

If you run a food business, you can choose to operate under a food control plan. This is true even if your food business is considered low risk under the rules in section 21(3) or section 25. Other parts of the law, like sections 21, 23, 25, and 28, do not stop you from making this choice.

You can make this choice if the usual rules would not require a food control plan for your business. You can also make this choice if there are no usual rules for your type of food business. You get to decide if you want to operate under a food control plan or not.
