The Governor-General can make rules about checking food businesses to make sure they are safe. You need to know that these rules can say who has to be checked, what parts of their business need to be checked, and how often they need to be checked. The Minister has to make sure people have been asked for their opinions before these rules are made, as stated in section 379.

The chief executive can also make rules about how food businesses are checked, including how often and how thoroughly. They can make these rules using section 405, and they can add to the rules made by the Governor-General. These rules are important because they help keep you safe when you eat food.

133FRegulations and notices relating to verification

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations for all or any of the following purposes:

  2. specifying a person who trades in food as a person to whom this subpart applies:
    1. specifying the operations or the part of the person’s operations that must be verified:
      1. prescribing requirements relating to the exercise, carrying out, and managing of verification functions and activities:
        1. specifying matters in relation to verification that must be included in a food control plan.
          1. Before recommending the making of regulations under this section, the Minister must be satisfied that there has been appropriate consultation on the regulations in accordance with section 379.

          2. The chief executive may, by notice under section 405,—

          3. prescribe requirements relating to the verification of those operations, including requirements relating to the frequency, intensity, and cost of verification; and
            1. supplement regulations made under this section.
