56Criteria for registration of food control plan

  1. The registration authority must register a food control plan if satisfied that—

  2. the food control plan complies with the applicable requirements of this Act; and
    1. if implemented appropriately, the food control plan will enable safe and suitable food to be traded; and
      1. either,—
        1. if the plan applies to 1 food business, the operator of the food business is a New Zealand resident (within the meaning of section YD 1 or YD 2 of the Income Tax Act 2007); or
          1. if the plan applies to more than 1 food business, every operator of the food businesses and the operator of the plan are New Zealand residents within the meaning of either of those sections of that Act; and
          2. either,—
            1. if the plan applies to 1 food business, the operator of the food business is able to comply with the requirements of this Act; or
              1. if the plan applies to more than 1 food business, every operator of the food businesses and the operator of the plan are able to comply with the requirements of this Act; and
              2. the plan is clear enough to be readily understood by the operator, the relevant registration authority, and the operator’s verifier or verification agency.
