430: Pre-commencement registered food safety programme

If you have a food business with a registered food safety programme that is already in force on the relevant appointed date, this section applies to you. You have a registered food safety programme that is deemed to be a registered food control plan until the date specified in section 433. This means you can keep using your current programme for a while.

You can choose to be covered by the applicable risk-based measure during the authorised transition period for your food sector. This is an option for you, and you can decide what works best for your business.

You must keep all the records you were required to keep before the relevant appointed date by the Food Act 1981 or by your food safety programme until the end of this Act's introductory period.

430Pre-commencement registered food safety programme

  1. This section applies to a food business that has a registered food safety programme that is in force on the relevant appointed date.

  2. The registered food safety programme is deemed to be a registered food control plan until the date specified in section 433.

  3. However, this section does not prevent the food business from choosing, during the authorised transition period for the food sector that the food business is in, to be covered by the applicable risk-based measure.

  4. The food business must retain until the end of this Act's introductory period all the records that it was required to keep before the relevant appointed date by the Food Act 1981 or by its food safety programme.
