If you have a special licence to sell alcohol for people to drink somewhere else, you must follow some rules. You can only sell or give away your own alcohol on the premises. You cannot give away free alcohol samples for people to drink on the premises when you are not open for selling alcohol to be taken away.

You also cannot sell alcohol for people to drink on the premises unless you have another special licence that lets you do that. This other licence is called an on-site special licence.

When you have a special licence for off-premises consumption, you must make sure you are not breaking these rules while your licence is in force.

55Requirements relating to special licences for consumption off-premises

  1. The holder of a special licence designated as an off-site special licence must ensure that, while it is in force,—

  2. only the licensee's alcohol is to be sold or supplied on the premises; and
    1. alcohol is not supplied free, as a sample, for consumption on the premises, at a time when the premises are not open for the sale of the licensee's alcohol for consumption somewhere else; and
      1. alcohol is not sold for consumption on the premises at any time when the licensee does not also hold for the premises a special licence designated as an on-site special licence.
