253Allowing disorderly conduct on licensed premises
The licensee or a manager of any licensed premises who allows any violent, quarrelsome, insulting, or disorderly conduct to take place on the licensed premises commits an offence.
A person who commits an offence against subsection (1) is liable on conviction to a fine of not more than $10,000.
It is a defence to a charge under subsection (1) if the defendant satisfies the court that, as soon as the defendant or any employee of the licensee became aware of the situation, reasonable steps were taken in respect of each person involved in the conduct concerned either—
- to take the person to a place of safety on the licensed premises; or
- to remove the person from the licensed premises.
