Sale and Supply of Alcohol Act 2012

Licensing trusts, community trusts, and other matters - Licensing trusts - Amalgamation of licensing trusts

344: Amalgamation by Order in Council

You could also call this:

"Merging licensing trusts by a special government order"

If you want to amalgamate some licensing trusts, they must send a proposal to the Minister if the proposal is approved under section 343(4) or if no poll is required. You must also send copies of the latest audited financial statements of each trust. The Minister will look at the proposal and may recommend that the Governor-General amalgamate the trusts by Order in Council. The Governor-General can then amalgamate 2 or more licensing trusts into 1 new trust and define the district of the new trust, and this order is secondary legislation, which has its own publication requirements as outlined in Part 3 of the Legislation Act 2019.
