343: Poll on amalgamation proposal

If a notice is published about a proposal to amalgamate licensing trusts, you can ask for a poll on the proposal. You have 40 working days to make this request in writing to the trust you are an elector of, after the notice is published under section 341. The trust will tell you how to do this.

The trust must hold a poll if at least 15% of electors ask for one. When a poll is held, it must follow the rules made under the Sale and Supply of Alcohol Act 2012.

The proposal to amalgamate the trusts is approved if most of the valid votes are in favour of it.

343Poll on amalgamation proposal

  1. The electors of the trusts concerned may, within 40 working days of publication of a notice under section 341, by written notice to the trust of which they are individually electors request a poll of electors to be held on the amalgamation proposal.

  2. The trust must arrange for a poll to be held if 15% or more of electors request it.

  3. A poll required to be held under subsection (2) must be conducted in accordance with regulations made under this Act.

  4. The amalgamation proposal is approved if a majority of the number of valid votes recorded is in favour of the proposal.
