When you want to apply for a special licence, you must file your application at least 20 working days before the event starts. You file it with the licensing committee for the area where the event will be held, or where your main business is, if the event is on a vehicle. You do this so the committee has time to consider your application. The committee looks at where the event is or where your business is to decide who gets your application.

If you file your application less than 20 working days before the event, the licensing committee might still consider it if they think you could not have predicted you would need a special licence earlier. They will talk to the Police and the Medical Officer of Health about your application. The committee will then decide how long the Police and Medical Officer of Health have to give their reports on your application.

If the committee gives them less than 15 working days to report, they will tell them when they send the application, as stated in section 141(1). The committee will also tell an inspector and the Medical Officer of Health about the time frame. When the committee sets a shorter time frame, section 141 will use the new time frame instead of 15 working days for reports on your application.

137Filing of applications

  1. An application for a special licence must be filed, at least 20 working days before the day on which the event concerned begins,—

  2. with the licensing committee for the district in which the premises concerned are situated, if it is an application for a licence for premises that are not a conveyance:
    1. with the licensing committee for the district in which the applicant's principal place of business in New Zealand is situated, if it is an application for a licence for a conveyance.
      1. The licensing committee may consider an application for a special licence filed less than 20 working days before the day on which the event concerned begins, if satisfied that the need for a special licence could not reasonably have been foreseen earlier.

      2. If (under subsection (2)) the licensing committee decides to consider an application for a special licence filed less than 20 working days before the day on which the event concerned begins,—

      3. it must, after consulting the Police and the Medical Officer of Health, fix a period of less than 15 working days after receiving a copy of the application within which reports from the Police or Medical Officer of Health must be received; and
        1. it must notify the Police, an inspector, and the Medical Officer of Health of the period fixed when sending copies of the application under section 141(1).
          1. If the licensing committee fixes under subsection (3) a period of less than 15 working days, the references in section 141 to 15 working days must (in relation to any report on the application concerned) be read as a reference to the period fixed.
