Sale and Supply of Alcohol Act 2012

Licensing trusts, community trusts, and other matters - Licensing trusts - Establishment of licensing trusts

300: Licensing trust established by Order in Council

You could also call this:

"The Governor-General can create a special group to manage alcohol sales in an area by a special order."

The Governor-General can create a licensing trust for an area by Order in Council. You need to know that this can only happen if the area does not overlap with another licensing trust's district. The Order in Council can decide things like the trust's name, the area it covers, and how many members it has. It can also decide how many members are needed for a meeting and divide the area into smaller parts for elections.

When the Order in Council is made, it must set a date for the first election of trust members. It must also choose a person to chair the first meeting where the president of the trust is elected. The boundaries of the trust's area and smaller parts must match the statistical areas used by Statistics New Zealand.

An Order in Council is a type of secondary legislation, and if you want to know more about publication requirements, you can look at Part 3 of the Legislation Act 2019.
