Licensing trusts: Establishment of licensing trusts
300Licensing trust established by Order in Council
The Governor-General may, by Order in Council made on the recommendation of the Minister, establish a licensing trust for any area if that area does not overlap (wholly or partly) the district of any other licensing trust.
The Order in Council may do all or any of the following things in relation to the licensing trust:
- prescribe its name:
- define its district in accordance with subsection (4):
- prescribe the number of members:
- prescribe the number of members for a quorum at a meeting of the trust:
- divide (in accordance with subsection (4)) the district of the trust into wards for the election of members, and prescribe the names and boundaries of the ward and the number of members for each ward:
- make any other necessary provision for establishing the trust in accordance with this Part.
The Order in Council must—
- appoint the date for the first election of the members of the trust; and
- nominate a person to chair the first meeting of the members for the election of the president of the trust.
The boundaries of the licensing trust district and any wards must coincide with the boundaries of the current statistical meshblock areas determined by Statistics New Zealand and used for parliamentary electoral purposes.
