Sale and Supply of Alcohol Act 2012

Sale and supply of alcohol generally - Offences and closure of premises - Offences relating to minors and people under purchase age

240: Exemptions in respect of licensed premises

You could also call this:

“Having alcohol with a parent or guardian in some licensed places is allowed”

If you are under the purchase age, you can still have alcohol on licensed premises if you are with your parent or guardian. You must be in an area that is not restricted. Your parent or guardian must be the one to give you the alcohol.

If these conditions are met, section 239(1) and (2) do not apply to you. This means you are allowed to have alcohol in this situation. You are only allowed to have alcohol if your parent or guardian is with you and gives it to you.
