When you apply for a licence to sell or supply alcohol, the secretary of the licensing committee sends a copy of your application to the police, an inspector, and the Medical Officer of Health. The police get a copy if they are in charge of the police station near the premises where you want to sell alcohol, or near the secretary's office if you want a licence for a vehicle. The Medical Officer of Health gets a copy if the premises are in their district, or if your main business is in their district and you want a licence for a vehicle.

The inspector looks into your application and sends a report to the licensing committee. The police and the Medical Officer of Health also look into your application and send a report if they have any concerns about it. They must send their report within 15 working days of getting your application.

If the licensing committee does not get a report from the police or the Medical Officer of Health within 15 working days, they can assume that there are no concerns about your application. You get a copy of any report that is sent to the licensing committee.

103Police, Medical Officer of Health, and inspector must inquire into applications

  1. On receiving an application for a licence, the secretary of the licensing committee concerned must send a copy of it, and of each document filed with it, to—

  2. the constable in charge of the police station nearest to—
    1. the premises for which the licence is sought; or
      1. the secretary's office, where the licence is sought for a conveyance; and
      2. an inspector; and
        1. the Medical Officer of Health—
          1. in whose district the premises are situated; or
            1. in whose district the applicant's principal place of business in New Zealand is situated, where the licence is sought for a conveyance.
            2. The inspector must inquire into, and file with the licensing committee a report on, the application.

            3. The Police and the Medical Officer of Health—

            4. must each inquire into the application; and
              1. if either has any matters in opposition to it, must file with the licensing committee a report on it within 15 working days after receiving the copy of it.
                1. The licensing committee may assume that, if no report is received from the Police or Medical Officer of Health within 15 working days after the Police or Medical Officer of Health received the copy of the application, the Police or Medical Officer of Health does not oppose the application.

                2. The secretary must send to the applicant a copy of any report filed with the licensing committee under this section.
