128: Objections to renewal

You can object to an application to renew a licence if you do not want it to happen. You can do this as an individual or as a representative of a group or organisation. Any person can make an objection.

If you are a trade competitor, you can only object if the application affects you in a way that is not related to trade competition. You cannot object if you get help from a trade competitor to make the objection. You must put your objection in writing and give it to the licensing committee within 25 working days after the public notice is first published.

Your objection can only be about the things stated in section 131. The secretary will send a copy of your objection to the person who applied for the licence. You must make sure you follow the rules when making an objection.

128Objections to renewal

  1. Any person may object to an application for the renewal of a licence, whether as an individual or as a representative of a group or an organisation.

  2. However,—

  3. a trade competitor may object to an application only if the trade competitor is directly affected by the application in a way that does not relate to—
    1. trade competition; or
      1. the effects of trade competition; and
      2. a person may not object to an application if the person receives, or is likely to receive, direct or indirect help from a trade competitor to object to the application.
        1. Every objection must be in writing, and must be filed with the licensing committee within 25 working days after the first publication of the public notice of the making of the application.

        2. No objection may be made in relation to any matter other than those stated in section 131.

        3. The secretary must send a copy of every objection to the applicant.
