If you are part of a licensing trust, you need to know what happens when a meeting is called to discuss a resolution. You will get at least 5 working days' public notice of this meeting, which is to talk about a resolution passed under section 351. At the meeting, you can vote to either confirm or cancel the resolution.

When you vote, a majority of votes will decide whether to confirm or revoke the resolution. If you confirm the resolution, the trust will be converted to a community trust, but only after a poll is held under section 355.

If you revoke the resolution, the trust cannot pass another resolution under section 351 for at least 1 year after the original resolution was made.

354Meeting to discuss resolution

  1. A licensing trust must give not less than 5 working days' public notice of a meeting of electors to discuss a resolution passed under section 351.

  2. The meeting may resolve by a majority of votes to confirm or revoke the resolution.

  3. If the meeting confirms the resolution, then, subject to the result of a poll held under section 355, the trust must be converted to a community trust.

  4. If the meeting revokes the resolution, the trust must not pass another resolution under section 351 before 1 year or more elapses after the date of the resolution.
