157: Calling of public tenders for authorisations

When you want to submit a tender for an authorisation, you need to include some important information. You must specify what activity or activities you want to do. If your activity involves taking materials from the coast, you need to say how long you want to do this for and how much material you plan to take.

You also need to tell how much money you’re offering. This includes any payment you’ll make at the start and any royalties you’ll pay for taking materials. If you’re offering royalties, you should explain how these might change over time.

When you send in your tender, you need to include the required fee (if there is one). If you’re offering an initial payment, you must also include a cash deposit for this amount or provide a security that the Minister thinks is good enough. You also need to include any extra information that was asked for in the public notice about the tender.

158Requirements of tender

  1. Every tender for an authorisation shall—

  2. specify the activity or range of activities in respect of which the authorisation is sought; and
      1. in respect of an activity to which section 152(1)(b) applies, the maximum period of any proposed coastal permit, and the maximum amount of material proposed to be extracted under the permit; and
        1. specify the total remuneration offered, including—
          1. any initial payment for the authorisation:
              1. any royalty for the extraction of material, and any proposed formula for adjustment of royalty.
              2. Repealed
              3. Every such tender shall be accompanied by—

              4. the prescribed fee (if any) and, if an initial payment for the authorisation is offered, a cash deposit of that payment or equivalent security to the satisfaction of the Minister; and
                1. any additional information specified in the public notice calling for tenders.
