91B: When suspension of processing of notified application ceases

When a notified application is suspended, you can ask the consent authority to stop the suspension. You need to do this in writing or electronically. The consent authority must stop suspending the application if you make this request.

The consent authority will also stop suspending the application if you take your case to the Environment Court, if the Minister makes a special decision about your application, or if the consent authority decides to keep processing your application.

If the suspension stops, the consent authority will tell you in writing or electronically when this happened.

Remember, if you want the suspension to end, you can ask for it at any time while your application is suspended.

91BWhen suspension of processing of notified application ceases

  1. A consent authority must cease to suspend the processing of a notified application when—

  2. a request is received in accordance with this section; or
    1. the applicant lodges a notice of motion with the Environment Court under section 87G(2)(a); or
      1. the Minister makes a direction under section 142(2) in relation to the application; or
        1. the consent authority decides under section 91C to continue to process the application.
          1. The applicant may request the consent authority to cease to suspend the processing of a notified application if it is currently suspended.

          2. The request must be made by written or electronic notice.

          3. If a suspension is ceased under this section, the consent authority must give written or electronic notice to the applicant specifying the date on which the suspension ceased.
