58JCPlan may permit effects that wastewater or stormwater environmental performance standard does not deal with

  1. Subsection (2) applies if a wastewater environmental performance standard or a stormwater environmental performance standard provides that—

  2. an activity is permitted; or
    1. an activity does not require a resource consent.
      1. A plan may permit, and impose conditions that deal with, any effects of the activity that differ from those regulated or managed in the environmental performance standard.

      2. However, subsection (2) does not apply if the environmental performance standard provides otherwise.
