When you ask for changes to a plan and make an application at the same time, the regional council must listen to what you and others have to say about both things together. They do this in a special meeting called a hearing.

The regional council has to follow rules about how to hold these hearings. These rules are written in clause 8B of Schedule 1 of this law.

Sometimes, the council might not need to have a hearing. This can happen if no one says they want to speak at the hearing, or if everyone who said they wanted to speak changes their mind. The rules about when a hearing isn’t needed are in clause 8C of Schedule 1 of this law.

165ZVHearing of submissions

  1. The regional council must hear, under clause 8B of Schedule 1, any submissions on a plan change request and its concurrent application together.

  2. For the purposes of clause 8C of Schedule 1, a hearing is not required if, in addition, no person indicates they wish to be heard, or the request to be heard is withdrawn, in relation to the concurrent application.
