A “concurrent application” is when you apply for something under section 165ZN at the same time as asking for a plan change.

A “plan change request” is when you ask to change a plan. This request must do two things:

  1. It needs to be made under clause 21 of Schedule 1 about a rule mentioned in section 165ZK.

  2. It should ask to allow aquaculture activities and make any other related changes.

Also, this plan change request needs to be made either at the same time as a concurrent application or with the idea of making a concurrent application soon.

165ZLInterpretation

  1. In this subpart, unless the context otherwise requires,—

    concurrent application means an application made under section 165ZN that is made in conjunction with a plan change request

      plan change request means a plan change request—

      1. made under clause 21 of Schedule 1, in relation to a rule referred to in section 165ZK,—
        1. to provide for aquaculture activities; and
          1. to make any related changes; and
          2. made in conjunction with, or in contemplation of, a concurrent application.
