If you have a water permit to take or use water under the Regional Plan: Water for Otago, the expiry date might be extended by 5 years. This happens if your permit was granted on or after 18 March 2020 and it was only for 6 years or less. Your permit also needs to be valid on the commencement date. You can check if your permit is valid by seeing if it has not expired, or if it has expired but you are still using it under section 124. Your permit must not have lapsed under section 125, been cancelled under section 126, or been surrendered under section 138. The conditions of your water permit stay the same unless they need to change because the permit duration is extended. The Otago Regional Council will update your permit with the new expiry date within 2 years of the commencement date.

127CExtension of certain existing water permits under Regional Plan: Water for Otago

  1. The expiry date of a water permit authorising the taking or use of water granted under the Regional Plan: Water for Otago is extended by a period of 5 years after the date on which the permit would otherwise expire if—

  2. the permit was granted—
    1. on or after 18 March 2020; and
      1. for a duration of no more than 6 years; and
      2. the permit is valid on the commencement date.
        1. A water permit is valid on the commencement date if, on the commencement date, the permit—

        2. has not expired, or has expired but the holder is continuing to operate under the permit under section 124; and
          1. has not lapsed under section 125; and
            1. has not been cancelled under section 126; and
              1. has not been surrendered under section 138.
                1. The conditions applying to each water permit that is extended under this section continue to apply, unless a change to a condition is required as a consequence of extending the duration of the permit.

                2. Otago Regional Council must, within 2 years after the commencement date, update each water permit extended under this section to reflect the new expiry date for the permit.
