Resource Management Act 1991

Occupation of common marine and coastal area - Review of conditions applying to extended coastal permits

165ZFHM: Decision on review

You could also call this:

“Explains how a government group decides whether to change rules for using the sea and coast”

When a consent authority reviews a coastal permit under this part of the law, they need to make a decision within 2 years of starting the review. They have to decide if they want to add new conditions, change existing ones, or keep everything the same for the permit they’re reviewing.

To make this decision, the consent authority needs to do two things. First, they have to apply section 131 of the law, as much as it applies to this kind of review. They might need to make some changes to how they use that section for this specific review. Second, they need to think about any submissions they got from people during the review process, as mentioned in section 165ZFHL(2).

After they’ve made their decision, the consent authority needs to tell the people who were notified about the review and who made a submission. They should do this as soon as they can, and they need to tell these people in writing about what they decided.
