165V: Requirements for offers for authorisations

When you want to get permission to do something in a certain area, you need to make an offer. Your offer needs to say what you want to do and where you want to do it.

If you’re taking part in a tender, which is like a competition to get permission, you also need to say how much money you’ll pay and how you’ll pay it.

When you submit a tender, you need to give some money upfront or provide something else that the regional council agrees is just as good. You might also need to give extra information if they ask for it.

Whether you’re making an offer or a tender, you need to pay any fees that are required under section 36(1)(ca).

If your tender is chosen under section 165X, and you have to pay rent each year, the amount you pay might be reduced. This happens if you also have to pay charges for using the coastal area.

165VRequirements for offers for authorisations

  1. An offer for an authorisation must specify—

  2. the activity or range of activities in respect of which the authorisation is sought; and
    1. the site it applies to.
      1. In the case of a tender for authorisations, the tender must also specify—

      2. the total remuneration offered (including any annual rental component); and
        1. the form of payment of the remuneration.
          1. A tender must be accompanied by—

          2. a cash deposit (being payment in advance of part of the remuneration) or equivalent security to the satisfaction of the regional council; and
            1. any additional information specified in the notice calling for tenders.
              1. An offer or a tender must be accompanied by any charge payable under section 36(1)(ca).

              2. If a tender is accepted under section 165X, the amount of any annual rental component of the remuneration payable under subsection (2) must be reduced by the amount of any coastal occupation charges payable under section 64A for the occupation of the area concerned.
