If you are a consent authority and a port company has a section 384A coastal permit in your area, you must review the permit. You do this according to the rules set out in this subpart, which you can find in section 165ZZF. You have to do this review, and it is in addition to other rules that let you review the conditions of a coastal permit, or change or cancel them. These other rules include sections 127 to 129, which allow you to review conditions or the holder to apply for changes, and section 133, which is about the Environment Court's power to change or cancel a coastal permit under Part 12.

165ZZDRequirement to undertake review

  1. Each consent authority in whose area of jurisdiction a port company holds a section 384A coastal permit must undertake a review of the permit in accordance with this subpart (see section 165ZZF).

  2. This section is in addition to—

  3. sections 127 to 129, which provide for—
    1. a consent authority to review the conditions of a coastal permit; and
      1. the holder of a coastal permit to apply to the relevant consent authority to change or cancel any condition of a coastal permit; and
      2. section 133, which preserves the power of the Environment Court under Part 12 to change or cancel a coastal permit by an enforcement order.
