You can apply to extend your extant wastewater consent if you are the holder. You must apply to the Minister no later than 30 months after the commencement date. The Minister may ask you for more information to help make a decision. You need to give the Minister any extra information they ask for. The Minister will then decide whether to extend your consent. They can extend it to no later than 35 months after the commencement date. The Minister's decision is based on the information you provide. They must make a decision after you apply and give them any extra information. This is according to section 92 of the Local Government (Water Services) (Repeals and Amendments) Act 2025.

139EApplication to extend extant wastewater consent

  1. The holder of an extant wastewater consent may apply to the Minister for an extension of the expiry date of the extant wastewater consent.

  2. An application must be made no later than 30 months after the commencement date.

  3. For the purposes of deciding whether to grant an application, the Minister may require the applicant to provide such further information as the Minister considers necessary to enable the Minister to make the decision.

  4. If the Minister receives an application and any further information required under subsection (3), the Minister must decide whether to extend the expiry date of the extant wastewater consent to no later than 35 months after the commencement date.
