165ZS: Consideration of plan change request

When you ask for a change to a regional plan, the regional council can’t adopt your request right away. Instead, they may accept it for further consideration.

If the council accepts your request, you have 20 working days after they tell you about their decision to do a few things. If you also made an application along with your plan change request, and the council changed your request, you can either change your application or withdraw it and make a new one. If you didn’t make an application with your request, you can make one now.

Remember, the council will look at your request based on the rules in Schedule 1 of the Resource Management Act. This schedule explains how changes to plans are managed.

165ZSConsideration of plan change request

  1. The regional council—

  2. may not adopt a plan change request under clause 25(2)(a) of Schedule 1; but
    1. may accept a plan change request under clause 25(2)(b) of Schedule 1.
      1. If the regional council accepts a plan change request, the person making the plan change request may, within 20 working days after being notified of the council's decision under clause 25(5) of Schedule 1,—

      2. if a concurrent application has been lodged with the plan change request and the plan change request has been modified under clause 24 of Schedule 1,—
        1. amend the concurrent application; or
          1. withdraw the concurrent application and lodge a replacement concurrent application:
          2. if a concurrent application has not been lodged with the plan change request, lodge a concurrent application.
