Resource Management Act 1991

Environment Court - Environment Commissioners and Deputy Environment Commissioners

255: When a Deputy Environment Commissioner may act

You could also call this:

“A helper judge can fill in when the main judge is away or the boss judge says it's needed.”

A Deputy Environment Commissioner can take the place of an Environment Commissioner in two situations. First, when the Environment Commissioner isn’t available. Second, when the Chief Environment Court Judge thinks it’s necessary for the Deputy to step in.

When a Deputy Environment Commissioner is acting for an Environment Commissioner, they are treated as if they are a full Environment Commissioner of the Environment Court. This means they have all the same powers and responsibilities as a regular Environment Commissioner while they are filling in.
