Resource Management Act 1991

Occupation of common marine and coastal area - Plan change requests and concurrent applications for coastal permits in relation to aquaculture activities

165ZX: Consideration of plan change request and concurrent application

You could also call this:

“A council must look at changes to plans before deciding if someone can use the sea for fish farming.”

When you ask a regional council to change a plan and apply for something at the same time under subpart 4 of Part 7A, the council has to do two things in order. First, they’ll look at your request to change the plan. Then, based on what they decide about the plan change, they’ll look at your application.

If the council decides not to change the plan in a way that would allow your aquaculture activity, they have to say no to your application. This happens if your activity is still not allowed after they’ve made a decision about changing the plan.
