Resource Management Act 1991

Transitional provisions - Transitional resource consents

399: Applications received on same day

You could also call this:

"What happens when multiple applications are received on the same day?"

When a consent authority gets two or more applications on the same day, you need to know what happens next. If these applications are not about the same proposal and were not made by the same person, the authority has to follow some rules. The authority must process these applications in a certain order if granting one application would affect the others.

The authority looks at the dates on the applications and starts with the one that has the earliest date. They then work through the applications in order of their dates, with the latest date last. The authority follows the rules in the Resource Management Act 1991 when processing these applications.

The authority uses sections like section 390B(2), section 393(1)(c)(ii), or section 397(2)(b) to decide the order of the applications. You can find these sections in the Act to learn more about how the authority makes their decisions. The authority's job is to process the applications fairly and follow the rules.
